Terms & Conditions

1. Introduction

1.1. These Terms and Conditions apply to all childcare centres (hereafter referred to as "the Centre") that engage our services (hereafter referred to as "the Provider") for the provision of activities and programs including but not limited to multi-sports, Zumba dance, yoga, and languages.
1.2. By engaging our services, the Centre agrees to be bound by these Terms and Conditions.


2. Services

2.1. The Provider agrees to deliver the activities and programs as per any schedule and requirements agreed upon with the Centre.
2.2. The Centre is responsible for providing a suitable space for the activities.


3. Booking and Confirmation

3.1. All bookings must be made through our official website or through direct communication with our administrative team.
3.2. A booking confirmation may be sent to the Centre once the booking has been processed and accepted by the Provider.


4. Payment Terms

4.1. Payment terms will be specified in the invoice provided to the Centre.
4.2. Full payment must be made as per the terms outlined in the invoice to secure the booking.
4.3. In the event of late payment, the Provider reserves the right to charge interest on the outstanding amount at a rate of 1.5% per month.


5. Cancellation and Rescheduling

5.1. The Centre must provide a minimum of 4 weeks' notice for the cancellation or rescheduling of any booked activities or programs.
5.2. Failure to provide the required notice will result in the Centre being liable for the full cost of the cancelled or rescheduled activities.
5.3. The Provider reserves the right to cancel or reschedule activities in the event of unforeseen circumstances, such as staff illness or emergency. In such cases, the Provider will make reasonable efforts to notify the Centre as soon as possible and arrange for a suitable alternative.


6. Exclusion of Liability

6.1. The Provider shall not be held liable for any injury, loss, or damage sustained by the Centre, its staff, or its participants during the activities or programs.
6.2. The Centre agrees to indemnify and hold harmless the Provider from any claims, liabilities, damages, and expenses arising out of or in connection with the Centre's engagement of the Provider's services.
6.3. The Provider shall not be liable for any failure to perform its obligations under these Terms and Conditions where such failure is due to circumstances beyond the Provider's reasonable control.
6.4. The Centre is responsible for ensuring that its insurance policies cover participation in the activities and programs provided by the Provider.


7. Obligations of the Centre

7.1. The Centre is responsible for ensuring that all participants have obtained any necessary medical clearances and are fit to participate in the activities and programs.
7.2. The Centre must inform the Provider of any relevant medical conditions or special requirements of the participants.
7.3. The Centre must ensure appropriate supervision of the participants during the activities and programs.
7.4. The Centre must provide a safe and suitable environment for the activities, including compliance with all health and safety regulations.


8. Intellectual Property

8.1. All materials, content, and resources provided by the Provider during the activities and programs are the intellectual property of the Provider and may not be reproduced, distributed, or used without the Provider's prior written consent.


9. Data Protection and Privacy

9.1. The Centre agrees to the Provider using and processing personal data for the purposes of delivering the activities and programs.


10. Amendments to Terms and Conditions

10.1. The Provider reserves the right to amend these Terms and Conditions at any time. Any such amendments will be communicated to the Centre and will be effective from the date of communication.


11. Governing Law

11.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales.
11.2. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of New South Wales.


12. Acceptance

12.1. By engaging our services, the Centre acknowledges that it has read, understood, and agrees to be bound by these Terms and Conditions.
